ON THE ISSUE OF MEASURES TO PROTECT PROPERTY RIGHTS, LAND USE RIGHTS AND OTHER RIGHTS TO LAND

Abstract.

In civil law, the protection of property rights, land use rights, and other land-related rights is understood as a set of civil law measures aimed at preventing and remedying violations of property relations. The legal nature of protection consists of state enforcement measures that ensure the restoration and safeguarding of the owner’s rights. Civil law norms perform three main functions: establishing the ownership of property by specific subjects, creating conditions for owners to exercise their rights, and imposing liability for violations.

Protection methods are divided into general and special. General methods apply to the protection of all civil rights and include recognition of rights, self-defense, as well as public law measures such as invalidation of unlawful acts by state authorities. Special methods are aimed at protecting property rights and obligations. Property protection methods include vindicatory and negatory claims, which safeguard absolute rights related to specific property. Obligation-related protection methods, such as declaring transactions invalid, apply when obligations are breached.

A distinctive feature of property protection is the possibility to bring absolute claims against any violator, enabling effective restoration of possession and use of property. Additionally, civil law provides supplementary measures, including liability for damage to property and guarantees of compensation when property is expropriated by the state.

Thus, the protection of property rights represents a complex of preventive norms and effective legal remedies that ensure the preservation and restoration of the owner’s property interests.

EFFICIENCY OF IMPLEMENTED STATE PROGRAMS, THEIR SOCIO-ECONOMIC IMPACT ON THE DEVELOPMENT OF THE AGRO-INDUSTRIAL COMPLEX

The article analyzes the effectiveness of government programs, assesses their impact on sustainable demographic, socio-economic development of northern rural areas, including border areas, and studies the relationship between sustainable development of rural areas and the development of the agro-industrial complex. The article also studies objective and subjective factors affecting life satisfaction of the rural population, the level of development of social capital, economic, socio-political, socio-cultural opportunities for the formation, development and implementation of human capital in rural areas and employment in the agro-industrial complex. However, the effectiveness of the implemented government programs, their socio-economic impact on balanced territorial development and on the development of the agro-industrial complex have not been sufficiently studied, no analysis of the compliance of the implemented measures with the needs and expectations of the target audience has been carried out.

RIGHTS OF VISUALLY IMPAIRED INMATES IN PRISONS: REALISATION AND CHALLENGES

The article is devoted to the issues of observing the rights of visually impaired convicts serving their sentences in places of detention in the Republic of Kazakhstan. The problems of implementation of legislation aimed at the protection of this vulnerable category, including the lack of adaptive conditions and resources, are considered. The social and psychological consequences of isolation are described, and examples of successful foreign practices are given. The necessity of introduction of modern technologies, training of specialists and strengthening of control over the implementation of legal norms to ensure decent conditions for visually impaired convicts is emphasised.

This article examines the right to challenge administrative acts of State bodies as an integral and mandatory element of the constitutional right to judicial protection.

Administrative legal proceedings are one of the key jurisdictional forms of protection of subjective public rights of an individual and should not be considered only as part of the mechanism of public administration. Issues of judicial control over the actions of administrative authorities, ensuring the claim by mechanisms of interaction with public authorities, including the possibility of challenging, deserve legal attention. It is necessary to focus on the regulatory practice of the bodies of the Supreme Court of the Republic of Kazakhstan, since it is this body that introduces the rules and procedure for the implementation of administrative proceedings to ensure the claim under consideration.

In general, the existing experience of administrative justice demonstrates successful trends and prospects for the legal regulation of an administrative claim (claims arising from public law relations to challenge decisions and actions of an administrative body).

This article is dedicated to analyzing the current issues associated with the process of collecting administrative fines in the Republic of Kazakhstan, as regulated by the Code of Administrative Offenses. The article provides a comprehensive analysis of the legal framework governing the imposition and enforcement of fines, as well as examines the consequences of non-compliance, including the application of compulsory enforcement measures within the framework of executive proceedings. Key problem areas identified include the suboptimal level of fine collection due to the population’s insufficient legal awareness, deficiencies in the system of informing debtors, and limitations in the effectiveness of enforcement authorities. Furthermore, the article analyzes the practice of evasion of fine payments by legal entities and highlights the presence of legal conflicts and ambiguities in regulatory procedures. As potential measures to improve the situation, the article proposes enhancing mechanisms for legal education of citizens, intensifying the activities of judicial enforcement officers, and tightening liability for evasion of administrative penalties. The conclusion emphasizes the necessity of developing and implementing a comprehensive approach to reforming the administrative fine collection system, which is expected to contribute to strengthening the rule of law and increasing public trust in state institutions.Начало формы

Today, the foundation of a successful economy is the full-fledged development of all its sectors, most of which are the real sector. At the same time, the trends in the historical development of the real sector of the economy imply an unconditional cyclical nature of the trends taking place in it, primarily the activities of its economic entities. Crisis phenomena periodically bring industrial enterprises out of balance. The scale of these phenomena can reach such a magnitude that their elimination is not amenable to management decisions, since the effectiveness of the latter can be achieved only in the early stages of crisis events. In modern realities, an effective anti-crisis management system at manufacturing enterprises is an essential component of solving strategic tasks. The acceleration of the rehabilitation processes of the post-crisis state of the enterprise requires the development of methods for the most effective anti-crisis management mechanisms in the manufacturing industry. In this regard, it is important to identify the basic principles and approaches to the formation of anti-crisis management mechanisms.

JUSTIFICATION OF NUCLEAR SAFETY DURING TEMPORARY STORAGE OF SPENT HIGHLY ENRICHED URANIUM FUEL FROM THE IVG.1M RESEARCH REACTOR

This paper presents the justification of nuclear safety during the temporary storage of spent highly enriched uranium (HEU) fuel from the IVG.1M research reactor. The aim of the study was to assess the level of criticality under various temporary storage scenarios and to verify compliance of storage conditions with regulatory requirements.

Based on neutron-physical calculations using the Monte Carlo method with the MCNP5 code, it is demonstrated that the proposed storage configuration provides a sufficient margin of subcriticality and complies with the regulatory documents of the Republic of Kazakhstan and international IAEA standards. Calculated parameters are presented, emergency scenarios are considered, and the obtained values of the effective neutron multiplication factor (keff) are analyzed. The results confirm that keff remains within nuclear safety limits even under deviations from normal conditions.

ANALYSIS AND DEVELOPMENT OF THE METHODOLOGY OF EXISTING MEANS OF EARLY DETECTION AND COUNTERING THREATS TO INFORMATION SECURITY

In the context of rapidly growing cyberattacks and increasingly sophisticated intrusion techniques, timely threat detection and response are becoming critically important. Modern early threat detection tools—such as SIEM systems, EDR solutions, and behavioral analysis technologies—enable the identification of potentially malicious activity before it results in actual damage. This paper reviews the methodologies implemented in the most widely used tools for early threat detection, classifies them based on their functional characteristics and effectiveness, and provides a comparative analysis. Based on the analysis, an approach is proposed for selecting and combining tools depending on the specifics of the protected infrastructure. Special attention is given to detection accuracy, resistance to evasion techniques, and the ability to automate incident response. The results of the study can be used to build comprehensive security systems tailored to current threats and security requirements
