On the duties of the court in security public / common interests

Abstract

The legislation of most countries, modeling the rules of law and filling them with dispositions of articles,
increasingly focuses on the private interest of the subjects of law. In this regard, there is a tendency in theory and practice
that characterizes the orientation of the law and its modeling to ensure private interest, which cannot be recognized as correct.
Only a "balanced" balance of interests, with the proper activity of the court, legislated in the form of positive obligations, will
contribute to the sustainability of the existence and quality functioning of the state.
