The constitutional right to freedom of labor and the non-competition agreement in Kazakhstan: problems of legislation and judicial practice

Abstract

The article reveals the content of the constitutional right to freedom of labor in the context of the terms of the noncompetition agreement. As a result of the analysis, the author identified gaps in the legislation of the Republic of Kazakhstan
and contradictions in judicial practice in terms of ensuring guarantees of the right to freedom of labor. Recommendations
have been developed to improve the current law of Kazakhstan in order to realize the citizens’ rights and ensure uniform
judicial practice
