Abstract

This article discusses the theoretical and legal aspects of the formation of the Institute of presidency, various systems
of presidential elections, particularly in the United States and France. The author dwells on the features of the Presidential
elections in Kazakhstan.
The author considers the establishment of the institution of the presidency, two models of the election of the head of
state were compared. The first is when the President is elected by a collegial body. The system of electing heads of state in the
Parliamentary republics, derived from the American model, based on the principle of choosing the President not by the
people, but by a certain circle of citizens. The second model of presidential elections is election by popular vote, which took
root in most states with a republican form of government, including in the Republic of Kazakhstan. In this case, each model
has its own characteristics and specific features that are peculiar to a particular nation. For example, the American model of
election of the President is not acceptable for the countries of the post-Soviet space, that's why the system of popular election
of the head of state was taken as the basis, which was the most optimal option
