Limitation of power in the context of the development of constitutionalism at the present stage

. The development of a theoretical understanding of constitutionalism and constitutional space entails the need to assess the role of the institution of limiting power in the construction of modern constitutionalism both in Russia and in Kazakhstan. The trend that has developed in recent years towards the transformation of the current legislation on the basis of changes in the constitutional reforms that have taken place in both states requires an assessment of the essence of such key principles as the democratic and legal nature of the state through the prism of the essence of constitutionalism. In order to develop one of the most important modern constitutional and legal principles - the principle of maintaining citizens' confidence in the law and the actions of public authorities, it is necessary to return to the issues of the limits of the exercise of power and the equal effect of the law in relation to public authorities and their officials and the people and citizens who make it up. . In this connection, works devoted to the essence of constitutionalism not only do not lose their relevance, but, on the contrary, are becoming increasingly important. The article attempts to rethink the institution of limiting power in the context of understanding modern constitutionalism.
