Abstract

The Constitution of the Republic of Kazakhstan follows the principle of separation of powers with some correction, since
our country is currently in special transition period and needs strong power of the President, as the main guarantor of
constitutional rights and freedoms of men and citizen, coordinating the activities of the legislative, executive and judicial
authorities in the state. At the same time, the Constitution provides for the democratic basis for the formation of all branches
of government, including the election of the President - Head of state by direct popular secret ballot. Modern democratic
social legal state should provide for the creation of comprehensive, consistent and hierarchical legal system in our state. Very
important feature of law-abiding state is the creation of special constitutional bodies, such as the Supreme or Constitutional
Courts. Democratic, legal, social state can be implemented and function high level of general and legal culture.
