Referendums as a means of law-making and constitutional control

This article discusses the constitutional foundations of the referendum, the types and characteristics of the
plebiscite, the history of the emergence of the referendum, the prevalence of the referendum in the modern world. The
study of the experience of holding a referendum has shown that the institution of the referendum is becoming more
and more popular today. In essence, a referendum (plebiscite) is one of the ways to exercise direct power. This article
examines the stages of the formation of a referendum as an institution of direct democracy. The aim of the study is to
study the formation and development of the institution of the referendum in the generalization of theoretical and
practical problems of the current legislation of different countries on the referendum. The object of this article is the
social relations arising from the implementation of the norms of the institution of democracy, as well as the basic
principles of legal regulation and organization of the referendum. The subject of the research is the state of the theory
of the institution of democracy, organizational and legal forms of the referendum. Over the course of many centuries,
the existence of the state as an organization of public power has improved the mechanism for the implementation of
this force. The article touched upon the problems of holding such a political and legal institution as a referendum. The
author made an attempt to comprehensively study the history of the origin and development of the referendum, and
this leads to the conclusion that the referendum is an integral part of the exercise of political power in a democratic
society.
