Abstract

There is no doubt that in legal science, legislation based on the mentality, traditions and culture of the population has the greatest effectiveness. This applies to legislation to combat crime and punish criminals. Because the history of crime on the way to its civilisation, as well as the history of the fight against unlawful behaviour of mankind lies in the distant past. It was during this continuous process that the legal system belonging to them, based on their legends and traditions, the so-called "traditional law" in the legal environment, was formed. At the same time, if a people has resisted external political, social, economic, societal, cultural and other upheavals, the more it has preserved and transformed into modern law the elements of customs reflecting its uniqueness and individuality.
