Actual problems of the application of administrative detention

Abstract

The problem of administrative detention is a very important and urgent task of authorized state bodies, since this measure is aimed at ensuring legality, law enforcement, and protecting the rights and interests of citizens.

In the system of measures to ensure the production of administrative offenses, administrative detention has the greatest organizational potential, since it allows you to quickly influence public relations arising in connection with the commission of administrative offenses.

A theoretical analysis of the institution of detention has revealed the actual problems of ensuring the legality of administrative detention in the activities of competent State bodies, especially in matters of restricting the freedom of minors and foreign citizens. We believe that special attention should be paid to guarantees of respect for the rights of detained citizens. We believe that guarantees of respect for the rights of a person who is actually detained by entities ensuring public order should be significantly strengthened.

The study allowed us to formulate some suggestions and recommendations for further improvement of the institution of administrative detention.
