About some issues of legal regulation of trade activities

Abstract

 In this article, the authors highlight the issues of regulation of trade activities in Kazakhstan and present their position in relation to the proposed legislative innovations.

The current situation of monitoring and control over compliance with pricing procedures and the responsibilities of a subject of a socially significant market is described. The results of ongoing monitoring are analyzed, as well as the role of one of the tools to curb the growth of the cost of socially important food products (SFP) – the introduction of ceiling prices – and its consequences.

The authors also focused on problematic issues of trade regulation aimed at protecting the interests of domestic producers. Namely, on unequal requirements for foreign and domestic entrepreneurs, on situations that are not in favor of domestic production and on proposed ways to solve these problems. The international experience of European countries is presented (in terms of introducing amendments to paragraph 3 of Article 172 of the Entrepreneurial Code of the Republic of Kazakhstan).

In order to support the development of domestic producers, create conditions for the development of competition and free trade, experts from the Institute of Parliamentarism sent proposals and comments to the deputies on the draft law on trade issues with justifications, which are reflected in this article.
