Abstract. In the context of external labor migration, the following rights occupy an important place: to work, wages, rest, labor protection and proper working conditions, etc. Violations of labor legislation and social and labor rights of migrants remain a pressing issue.
The goal of migration policy should be to find a balance between maximizing benefits and minimizing risks, legislatively securing the rights of migrant workers and their family members to social protection, sickness and disability benefits, etc.
It is necessary to take into account not only the current interests of the labor market, but also the migration context in the long term.
The analysis of regulatory legal acts in the field of migrants' rights in the CIS (Russia, Belarus, Kazakhstan, Kyrgyzstan) identified the main aspects related to migrant workers during their stay in the territory of the state of employment (when carrying out labor activities, applying for medical care, educational services, pension issues, etc.). In this regard, the scientific article analyzes and discloses some issues of legal regulation in the field of migration.
